Terms and Conditions of Business

1. General
1.1 These Terms and Conditions (“Terms”) apply to all work undertaken, goods supplied, and services provided by Thermatek Heating (“Thermatek”, “Thermatek Ltd”, “we”, “our”, “us”) to any client (“the Client”, “you”, “your”), whether domestic or commercial.
1.2 By instructing us, accepting a quotation, or allowing work to proceed, you agree to these Terms.
1.3 These Terms override any other terms proposed by the Client unless agreed in writing by Thermatek.
2. Quotations and Estimates
2.1 All quotations are valid for 30 days from the date of issue unless stated otherwise and agreed to in writing by Thermatek Heating.
2.2 Quotations are based on information provided at the time. Any changes to scope, access, materials, or unforeseen circumstances may alter the final cost.
2.3 Estimates are approximate and subject to revision once full requirements or site conditions are confirmed.
3. Acceptance of Work
3.1 Work will commence only after written or verbal acceptance of the quotation.
3.2 Acceptance of a quotation confirms your agreement to these Terms.
3.3 We reserve the right to refuse work if site conditions are unsafe or unsuitable.
4. Payment Terms
4.1 Payment is due immediately and no later than 5 days from the invoice date unless otherwise agreed in writing by management.
4.2 For larger projects, stage payments or deposits may be required.
4.3 Payment can be made by bank transfer, card payment, or other agreed method.
5. Late Payment and Charges
5.1 Invoices not paid by the due date will incur:
A £25 administration fee per overdue invoice, and interest at 4% above the Bank of England base rate per annum, calculated daily until full payment is received.
5.2 For business clients, these charges are made under the Late Payment of Commercial Debts (Interest) Act 1998.
5.3 For consumer clients, interest and reasonable admin fees may be charged under these Terms where clearly stated and fair.
5.4 If payment remains outstanding, the debt may be **referred to a debt collection agency**, and the Client will be liable for all associated recovery costs.
6. Ownership of Goods
6.1 All materials and goods supplied by Thermatek remain our property until full payment is received.
6.2 We reserve the right to recover or remove goods that have not been paid for in full.
7. Workmanship and Warranty
7.1 All work is carried out with reasonable skill and care and in accordance with industry standards.
7.2 We offer a 12-month workmanship guarantee** on labour unless otherwise stated.
7.3 Manufacturer warranties apply to materials and equipment as provided by the manufacturer.
7.4 The guarantee does not cover damage caused by misuse, lack of maintenance, interference by others, or issues arising from pre-existing faults.
8. Access and Site Conditions
8.1 The Client must provide safe and reasonable access to the property and work area.
8.2 Any delays caused by restricted access, obstructions, or unsafe conditions may result in additional charges.
9. Cancellations and Delays
9.1 For consumers, you have the right to cancel within 14 days of accepting a quotation (under the Consumer Contracts Regulations 2013), unless you request immediate work to begin.
9.2 If work is cancelled after materials have been ordered, within 24hrs of your booking or after work has begun, the Client will be responsible for costs incurred up to the point of cancellation and our cancellation fee.
9.3 We reserve the right to postpone or cancel work due to unforeseen circumstances, including safety concerns or supply chain issues.
10. Liability
10.1 Thermatek Ltd. shall not be liable for indirect or consequential loss, including loss of profit or income.
10.2 Our total liability shall not exceed the total amount paid for the relevant work.
10.3 Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.
11. Disputes
11.1 Any disputes regarding invoices or work completed must be raised in writing within 5 days of invoice receipt.
11.2 We aim to resolve issues promptly and fairly. If unresolved, either party may seek resolution through mediation or the Small Claims Court.
12. Data Protection
12.1 Client details are stored securely and used only for legitimate business purposes, such as invoicing and service records.
12.2 We comply with the UK GDPR and Data Protection Act 2018.

13. Governing Law
13.1 These Terms are governed by and interpreted according to the laws of Scotland.
13.2 Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
